Family Running Festival Waiver

The following waiver will be used by the Family Running Festival and West Chiltington Community School for the proposed event, the Family Funning Festival, and will be communicated to runners during the online registration process where they are asked to tick that they accept the following conditions:
 

 

Disclaimer

I myself, fully and forever waive and release any and all rights and claims for any injuries, accidents, and damages, including, but not limited to, demands or actions for negligence, premises liability, emotional injury, intentional conduct, resulting in unintended injury or damage tort claims, and any other actions or demands of whatsoever nature, to the fullest extent permitted by law, I have or may have against Family Running Festival and West Chiltington Community School, its employees, principals, directors, governors, shareholders, agents, partners, members, managers, affiliates, representatives and all sponsors of the the Family Running Festival.

Personal Health and Fitness

I understand that participation in the Family Running Festival (“Run”) is potentially hazardous. I acknowledge that I am aware of the inherent risks involved in the Run and I voluntarily assume these risks. I attest and verify that I am physically fit and I have sufficiently trained for the completion of the Run in which I participate. Family Running Festival and West Chiltington Community School reserves the right, in its absolute discretion, to stop any runner from taking part if it deems him or her unfit to run, including mid-race removal from the course where necessary.
I understand that the Run is non-competitive and that no racing is allowed. I further understand that the Run involves running as part of a larger group around the village of West Chiltington in West Sussex. I assume all risk of injury or death. I also understand that I should take every precaution to prevent serious injury and I agree to wear a protective active wear at all times during my participation in the Run.

 

Entry

I will not under any circumstances give my or my child’s race number to anyone else. Amongst other potential problems, doing so may cause problems of identification for the Run medical services (St John’s Ambulance) in the case of any accident or injury. Any attempt to do so will result in immediate disqualification of the individual(s) concerned and ejection from the event.
Family Running Festival and West Chiltington Community School reserves the right to reject any entry, and further reserves the right to change the details of the above-referenced events without prior notice. I understand that numbers are non-transferable.
 

Race Ejection

I understand that Family Running Festival and West Chiltington Community School reserves the right, in its absolute discretion, to refuse to allow anyone to participate in the Run either at the start or to continue participation at any point along the route of the Run, should he or she be deemed to behave inappropriately or give cause for concern that his or her continued participation may cause offence or injury to themselves, any spectators or other competitors. Failure to comply with any instruction from security staff, teachers and marshals will result in ejection from the Run.

 

Cancellation of the Run

Family Running Festival and West Chiltington Community School reserves the right, in its sole and absolute discretion, to postpone, cancel, or modify the Run due to unforeseen or unavoidable circumstances out of our reasonable control. In such cases, we will endeavour to inform participants as quickly as possible. Where the Run has to be postponed or cancelled due to circumstances outside of our reasonable control (including adverse weather conditions, Acts of God, Acts of Terrorism, etc.) Family Running Festival and West Chiltington Community School shall not be liable for any inconvenience, expenses, costs, losses or damages suffered by participants.

Collection and Use of Information

Family Running Festival and West Chiltington Community School will only use personal information regarding participants and any appointed third parties for purposes in connection with the Run and any subsequent runs or events that we may organise or administer. By entering the Run, I grant full and irrevocable permission for Family Running Festival and West Chiltington Community School to pass any medical details I have given to the medical teams operating on the day of the Run.

Photography

Family Running Festival and West Chiltington Community School would like to be able use the images of participants that are taken during the Event for publicity purposes. I hereby grant full permission to Family Running Festival and West Chiltington Community School to use my voice and/or my picture in any broadcast, advertising, promotion, or other account of this Run for marketing purposes. Furthermore, Family Running Festival and West Chiltington Community School will follow these guidelines for the use of photos or images of young people. Please note that web sites can be viewed throughout the world, not just in the UK, where UK law applies.

Please read the following conditions for using these images:
 Family Running Festival and West Chiltington Community School will not include details or full names (which means first name and surname) of any child in an image, on video, on our website, or in printed publications, without good reason. For example, Family Running Festival and West Chiltington Community School may include the full name of a prize winner if we have their consent. Family Running Festival and West Chiltington Community School will not include personal email or postal addresses, or telephone or fax numbers on video or on our website or in our printed publications.

If Family Running Festival and West Chiltington Community School uses images of individual young people, we will not use the surname of that child in the accompanying text or photo caption. In specific circumstances, such as where Family Running Festival and West Chiltington Community School wishes to include a picture and full name of a competition winner, we will request written parental consent first. Family Running Festival and West Chiltington Community School may use group images with general labels. Family Running Festival and West Chiltington Community School will only use images of children who are suitably dressed, to reduce the risk of such images being used inappropriately.

 

Physical Contact

By its very nature sport can require a degree of physical contact between adults and young people. Physical contact can be used appropriately to instruct, encourage, protect or comfort. By entering, I agree to allow such physical contact where it is reasonably required in order to treat an injury, prevent an injury or for other reasons of health and safety.
